Delay Opening of Scallop Season in Trustee Waters

Resolution # 2022-32

2022 REGARDING DELAYING THE OPENING OF SCALLOP SEASON IN TRUSTEE WATERS UNTIL NOVEMBER 13, 2022

The following Resolution was offered and unanimously adopted:

WHEREAS, §213-18 of the East Hampton Town Code recognizes the Trustees’ authority to vary the permissible dates for the taking of scallops; and

WHEREAS, §213-12 of the East Hampton Town Code permits the taking of scallops from Trustee waters between the third Monday in October and March 31 in each year; and

WHEREAS, for the year 2022, the State has set the opening of scallop season in State waters as of November 7, 2022; and

WHEREAS, Trustee waters have traditionally been opened for scalloping shortly after the opening of State waters.

NOW, THEREFORE, BE IT RESOLVED THAT, despite the provisions of §213-12 of the East Hampton Town Code, scallops may not be taken from Trustee waters between 12:01 a.m. on Monday, October 17, 2022 and before sunrise on Sunday, November 13, 2022. Instead, the 2022 season for taking of scallops from Trustee waters shall begin at sunrise on Sunday, November 13, 2022 and end at sunset on March 31, 2023, and be it further

RESOLVED, that the reason for this delayed opening is to permit additional time for scallops to spawn, and be it further

RESOLVED, that except as set forth above, all other provisions of Chapter 213 shall remain in effect, and be it further

RESOLVED, this Resolution shall take effect upon the filing of same with East Hampton Town Clerk and posting as set forth in §213-18 of the Town Code.
