Shellfish Dealers and Shellfish Harvesters,

DEC-Shellfisheries collected water samples in several of the areas that DEC designated as temporarily uncertified (closed) on August 19, 2024, after the extraordinary rainfall event in excess of three (3) inches in Nassau and Suffolk Counties on August 18 – 19, 2024.  Testing results from those samples indicated that the following areas can be re-opened to the harvest of shellfish.  

Effective at 10:00 AM EST, Wednesday, August 28, 2024, the following areas are reopened to the harvest of shellfish, except as described in 6NYCRR, Part 41, “Sanitary Condition of Shellfish Lands.”

1.    Town of East Hampton: All the normally certified areas of Accabonac Harbor and Montauk Harbor.

A copy of the signed order re-opening all the normally certified areas in the embayments listed above is attached and the text of the rescission order is below.

    RESCISSION OF EMERGENCY DESIGNATION OF SHELLFISH LANDS

IN THE STATE OF NEW YORK

AS UNCERTIFIED FOR THE HARVEST OF SHELLFISH

Pursuant to the provisions of Subdivisions 13-0307 (1) and (2) and Subdivision 13-0309 (1) of the Environmental Conservation Law and Sections 42.17 and 47.4 of Title 6 of the Official Compilation of Codes, Rules and Regulations of the State of New York, and based upon the determination that conditions that may cause shellfish to be hazardous for use as food are no longer present, I, Martin L. Gary, Director, Division of Marine Resources, of the Department of Environmental Conservation, hereby rescind specific sections of the order dated August 19, 2024, that designated particular shellfish lands as uncertified for the harvest of shellfish. This order is effective at 10:00 AM EST, Wednesday, August 28, 2024, and applies only to the areas specified below, except as described in 6NYCRR, Part 41, “Sanitary Condition of Shellfish Lands”.

Accordingly, the harvest of shellfish from the following areas is permitted:

1.       Town of East Hampton: All the normally certified areas of Accabonac Harbor and Montauk Harbor.
